Lawsuit filed over judicial center work dispute

A lawsuit has been filed over a dispute connected to work done at the new Washington County Judicial Center.

According to a case filed in the Washington County Circuit Clerk’s Office, Whitehead Electric Company of Sturgis, Ky., is seeking $657,396.21 in a suit against Codell Construction Company of Winchester, Ky., as well as the Washington County Fiscal Court and Travelers Casualty and Surety Company of America, based in Hartford, Conn.

The suit states that Whitehead is seeking this sum because the company’s work was unreasonably disrupted and delayed due to acts or omissions of Codell and/or its respective agents or subcontractors, and that those disruptions and delays were not reasonably expected at the time of contracting. The suit claims these delays caused Whitehead to incur uncompensated damages over and above the subcontract amount.

Officials with Whitehead Electric Company declined to comment.

John Hays, an attorney for Codell Construction Company, said it is company policy to not comment on litigation, but added that he plans to defend the case.

“I can tell you I’m going to defend it. We have valid defenses, and we’ll let our pleadings speak for themselves,” Hays said. “I feel this is something that is defensible.”
